Contracts - Interpretation

Evidence - Parol Evidence Rule

Sattva Capital Corp. v. Creston Moly Corp. (SCC, 2014)

In this case the Supreme Court of Canada re-states the doctrine of contractual interpretation, clarifying that for appeal purposes it is a question of mixed fact and law [paras 42-58], and that 'surrounding circumstances' may be taken into account for interpretation without offending the parol evidence rule [paras 59-61].
