Estoppel - Proprietary

Real Estate - Prescriptive Easements

Gold v Chronas (Ont CA, 2015)

In this case the Court of Appeal engages in an extended and very useful discussion of proprietary estoppel (and to a lesser extent, prescriptive easements) in the context of a claim for right-of-way across another owner's property. Particularly useful is the court's consideration of the impact of the statutory provisions of the Registry Act and the Land Titles Act on these issues, and it's consideration of their legislative history. I would say that this case is essential reading for anyone involved in such a case.
