. Mendioro v. Canada (Attorney General)

In Mendioro v. Canada (Attorney General) (Fed CA, 2026) the Federal Court of Appeal considered whether the EI Commission had jurisdiction to write off an EI 'debt':
[6] With regard to inability to repay, the SST-AD noted Ms. Mendioro’s request that the debt be forgiven (written off) on this basis, and it recommended that the Commission consider this request. However, it is implicit in this recommendation that the SST-AD was of the view that it did not have jurisdiction itself to write off the debt. In this view, the SST-AD agreed with the SST-GD, which discussed the issue in its decision, and even provided contact details for requesting that the debt be written off, as had the prior notices of debt. We agree that it was not within the jurisdiction of the SST-AD to write off the debt. It is likewise not within the jurisdiction of this Court to do so. That is a decision for the Commission (see paragraph 153.1306(1)(f) of the Act).
