Fairness - Livelihood

. Watter v. McMaster University

In Watter v. McMaster University (Ont Div Ct, 2025) the Ontario Divisional Court dismissed a JR, this against McMaster University Board of Governors deciding "that adequate cause existed to remove Dr. Watter from his faculty position ... ."

Here the court notes the high degree of procedural fairness accorded to issues of personal livelihood:
[51] In considering the Baker factors, it is not open to dispute that a significant degree of procedural fairness is required in this case. Processes that affect one’s livelihood or the ability to pursue a profession will generally attract a high level of procedural fairness: Ford v. University of Ottawa, 2022 ONSC 6828 (Div. Ct.), at para. 55; Filippova, at para. 74.
