APPLICATIONS

I suspect some irregularity in the cases with the use of the term 'pleadings' wrt applications (as opposed to 'actions', where it is correct). As I read R14.09 ['Originating Process - Striking out or Amending']: "An originating process that is not a pleading may be struck out or amended in the same manner as a pleading", the correct term for the textual content of an application is 'originating process' - not 'pleadings'. Thus you can amend or strike out a Notice of Application, which is an originating process - but the text is not a pleading.

See on a related issue: Hull & Hull - 'Amending Applications and the “Close of Pleadings”' where the author cites an Ontario CA case that the 'pleadings' in an application are the affidavit material.
