Condominiums - Arbitration. Mensula Bancorp Inc. v. Halton Condominium Corporation No. 137
In Mensula Bancorp Inc. v. Halton Condominium Corporation No. 137 (Ont CA, 2022) the Court of Appeal notes that disagreements respecting Condo declarations must go to arbitration:[16] The parties were required to take their dispute to arbitration. Section 132(4) of the Condominium Act, 1998 deems a declaration to contain a provision that the corporation and the owners agree to submit a disagreement with respect to the declaration to arbitration.
